Mr.
Sunday was on a visit to University of Lagos, Nigeria with his friend who was a
student. They both went to charge their phones in an open space and while
waiting for the phones to charge, another student showed up and pleaded to use
Mr. Sunday's charger which had two spots. An hour later, he went to use the
restroom. During this time, the owner of the phone got back and realized his
phone was missing.
They
met Mr. Sunday in the restroom and started arguing as to what happened to his
phone. The School Security arrested Mr. Sunday and he was later charged on a 2
Count Charge of Breach of Peace and Stealing of a Phone, he was arraigned on
the 21st of February 2022 and granted bail before the Court further set down his
case for Trial on the 30th March 2022.
His
friend got in touch with us and his case was assigned to our lawyer- Emmanuel Oroko
who debrief him, and prepared for his trial which commenced on the 30th of
March 2022 with the prosecution calling its first witness after which the
matter was adjourned to 14th May 2022.
Sequel
to his financial status which prevented him from perfecting his bail, our
lawyer made a compassionate plea to the Court regarding his bail terms and the
Court allowed his mother to stand for him at no cost and he was released to his
family. He had spent 3 months in custody before his bail was perfected. The
witness didn't return to Court for cross-examination and he also mentioned
while testifying in Court that the phone was later found.
Subsequently,
from the 14th of May 2022, the case suffered a series of adjournments, until
the 6th of October 2022, our Lawyers-Emmanuel_Oroko and Oshodi Ajibike both
appeared for him and applied that the Charges against him be dismissed for want
of diligent prosecution. The Court granted the Application and Discharged him.
