Left Cote D'Ivoire to Set up His Business in Nigeria But Ended up Spending 7 Months in Prison
Emmanuel Uba is a 36 year old Trader from Imo state, Nigeria. He learnt his trading skills from Cote D’Ivoire, and last year, he decided to return to Nigeria to establish his own business.
However, because he didn’t have money to execute it, he stayed in Lagos in order to gather some money to start up his business. Luckily for him, he got an opportunity to work as a Security Guard, guarding the house of his boss who lives alone (even when he travels and no one is left but Emmanuel).
Unfortunately, the house was burgled through an opening that had been on the fence but which the boss didn't fix. This incident happened the night Emmanuel went to his brother's place where he stays sometimes and he couldn't come back to return to work that night. He came back in the morning to find out that the house had been burgled. After his boss came back from his travel, he got Emmanuel arrested for the incident.
On April 24, 2022, Emmanuel was arrested and taken to Ijesha police station where he was detained and questioned. He was later charged to court for burglary and stealing and remanded in Ikoyi prison. Though he was given bail by the court but his family didn’t come forward to perfect the bail because they were angry with him on why he stayed in Lagos instead of returning to Imo state after he came back from Cote D'Ivoire.
On one of her routine visits to the court cell, our Lawyer, @Juliet met Emmanuel and took his brief.
Upon her investigation into the matter, our Lawyer discovered that the charge against Emmanuel was a vexatious charge because both the complainant and the prosecutor has since abandoned the matter in court with no appearance and no reason put forward. We therefore brought our argument before the court that the defendant should be discharged and not be abandoned in custody. In fairness the court agreed, and Emmanuel was discharged and released.
Emmanuel spent 7 months in custody.
